<br />C <br />Minutes, October 18, 1989 <br />PAGE 8 <br />A pre-hearing conference will be held, before a final decision is made <br />regarding the company's application for an amendment. <br />Objectors present were asked to present objections, regarding the <br />corrective action plan, by October 25, 1989. The Division would <br />complete discussions about corrective actions by November 15, 1989. <br />Before November 30, 1989, a meeting would be held with the Division, <br />company and objectors, regarding the corrective action plan. The <br />Division would report to the Board at its December Meeting, regarding <br />this matter. <br />Staff Presentation by Steve Renner: <br />11. Consider modification of September Board Order. <br />• <br />Regarding this issue, Staff reviewed the Board's decision from the <br />September Board ideeting. At that Meeting, the Board found the operator <br />in violation of Act 34-32-111 and for mining without a permit. Part of <br />that Order directed the operator to submit a reclamation only I11 <br />permit by October 23, 1989. At that time, the operator related they <br />would have no future use for the site. Subsequently, the operator's <br />attorneys contacted the Division and requested that the Board ~:hange <br />the September Board Order from obtaining a reclamation only 111 permit <br />to obtaining a 110 permit. <br />The Division endorses the operator's request for obtaining a 110 permit. <br />Mr. Tony Collins, with Kiewit Western Company, answered questi~ms from <br />the Board. <br />it was MOVED that the Board modify Corrective Actions and dire~:t the <br />operator o obtain a permit.
