§ 34-32.50-103(13) defines mining operations to include the extraction of construction material from its
natural occurrence on affected land.
8. The definition of mining operations involves extraction of construction material from its natural
occurrence. The Petitioner's proposal involves no excavation of construction material from its natural
occurrence. The gravel in question has already been extracted from its natural occurrence. Therefore,
this type of activity should be exempt from the requirement of a reclamation permit.
ORDER
Based on the above findings of fact and conclusions of law, the Board declares that Brent Thurgood's project, as
described in its petition, is not subject to the permitting requirement in § 34-32.5-109, C.R.S.
DATED tht~ day of \ " _'y ~' , 2002.
FOR THE COLORADO MINED LAND RECLAMATION BOARD
Michael B.
