<br />• NOV C-91-031 <br />Southfield Mine <br />Failure to maintain sediment ponds. <br />HISTORY: No violations in the past 12 months. <br />SERIOUSNESS: Seriousness of the violation is low since the ponds <br />apparently still had adequate capacity to contain a 10-year storm <br />event. However, failure to remove accumulated sediments increased <br />the likelihood of a pond discharge in exceeding NPDES effluent <br />limits. <br />Failure to repair the damaged outlet pipe would only have impacted <br />the function of the pond if a 25-year storm event had occurred. <br />FAULT: The operator was negligent in not repairing the damaged <br />outlet pipe when it was damaged. The operator also failed to <br />remove accumulated sediment when those sediments had exceeded the <br />maximum sediment level marker in the pond. <br />GOOD FAITH: Good faith is not applicable since the violation has <br />not yet been abated. <br />c:\wp51\lpr\1r25c <br />
