• NOV C-91-031
Southfield Mine
Failure to maintain sediment ponds.
HISTORY: No violations in the past 12 months.
SERIOUSNESS: Seriousness of the violation is low since the ponds
apparently still had adequate capacity to contain a 10-year storm
event. However, failure to remove accumulated sediments increased
the likelihood of a pond discharge in exceeding NPDES effluent
limits.
Failure to repair the damaged outlet pipe would only have impacted
the function of the pond if a 25-year storm event had occurred.
FAULT: The operator was negligent in not repairing the damaged
outlet pipe when it was damaged. The operator also failed to
remove accumulated sediment when those sediments had exceeded the
maximum sediment level marker in the pond.
GOOD FAITH: Good faith is not applicable since the violation has
not yet been abated.
c:\wp51\lpr\1r25c
