At <br />this time it is anticipated that the Board will issue an order to the Trinidad <br />Basin Mining Company to complete reclamation activities on the Trinidad Basin <br />Mine by a date to be determined at the Board Meeting, probably May of 1991. <br />As you nay recall, the Division started bond forfeiture procedures against <br />Vance Mills for failure to conduct reclamation at the Trinidad Basin Mine. <br />However, Mr. Mills indicated to the Board that he had not been allowed to <br />access the site and therefore could not conduct reclamation. In order for <br />Trinidad Basin Mining Company to complete their reclamation activities and <br />prevent bond forfeiture, it is imperative that they have access to the mine <br />site. Therefore, the Division is requesting on behalf of Trinidad Basin Mine <br />that you allow access to the mine site to conduct continuing reclamation <br />activities. I have spoken to your son, John Wiggins, about the access issue <br />and he has indicated that it would not be a problem and never has been a <br />problem. The Division is enclosing a letter for your review and approval <br />which simply states that you will allow Mr. Mills onto the mine site to <br />conduct his reclamation activities, as required by the Colorado Surface Mining <br />Act and the Mined Land Reclamation Board. By returning the letter it allows <br />the Division to provide tangible evidence to the Board that clearly shows <br />Mr. Mills does have access to the site and will be able to per farm the <br />required reclamation. <br />Upon conclusion of the Board meeting and issuance of the Board Order the <br />Division will contact you with results of the outcome and see if you have any <br />additional questions or concerns. Also we ask that you return the letter in <br />the enclosed self-addressed, stamped envelope as soon as possible. The <br />November Board hearing will be held on November 14 and 15, 1990 and we would <br />like to present your letter at that time. <br />STATE OF COLORADO <br />
