Banta, <br />Oivisian Director <br />T0: Interested P ies <br />FROM: Fred Banta 'vision Director <br />RE: Division Recommendation, Alma Placer Amendment (File M-85-029) <br />Pursuant to the May 25, 1990 order, the Mined Land Reclamation Division has <br />prepared its recommendation concerning Reclamation Resources amendment application. <br />As required by the pre-hearing order, the Division has reviewed all materials <br />submitted on or before June 8, 1990. This review indicated that Reclamation <br />Resources has not demonstrated compliance with portions of Rule 6 of the Minerals <br />Rules and Regulations, and the Mined Land Reclamation Act CRS 34-32-116. <br />The specific areas of concern which have not been addressed are: <br />1) Routing of all affected area drainage through Pond 1 (Rule 6.2(2), <br />CRS 34-32-116(7)(8)); <br />2) Routing 25 year flood around site without causing damage (Rule 6.2(1), <br />CRS 34-32-116(7)(8); 115(4)(c)); <br />3) Pond capacity and operational water volume requirements (Rule 6.2(1), <br />CRS 34-32-116(7)(8); <br />4) Sealing of Pond 1 to minimize outflows (Rule 6.2(1); CRS 34-32-116(7)(8); <br />115(4)(c)); <br />5) Demonstration of Pond 1 embankment stability (Rule 6.2(1); <br />CRS 34-32-116(7}(g); i16(7)(h)}, <br />As the applicant has not demonstrated compliance with Rule 6 and Section 116 of the <br />Act, the Division recommends denial of the amendment application pursuant to <br />(CRS 34-32-115(4)(8)). <br />cc: Mined Land Reclamation Board <br />Bruce Humphries <br />Steve Renner <br />Larry Oehler <br />Tom Schreiner <br />Frank Johnson, Attorney General <br />Division of Wildlife <br />8171E/scg <br />
