iiiiiiiiiiiiiiiim • <br />• <br />PERMITTED 110(1), 110(2), AND PROSPECTING OPERATIONS <br />Presentation Porm <br />GENERAL INFORMATION <br />File No: M-77-044 Date: Aug 23-24, 1995 <br />operator: Coatilla County Commodity: Sand and Grav <br />Location: Coatilla County Acreage: 8.4 ac <br />Specialist: Bob Oswald <br />NATURE AND DURATION OF VIOLATION <br />Operator was informed of a problem related to unprotected and <br />inadequate amounts of topsoil, which was to be corrected by <br />11/15/94. The operator has submitted no proof that the required <br />corrective actions were completed. The duration ie from the <br />corrective action date until present, a total of 282 days. <br />SERIOUSNESS <br />D C B A <br />***** (A) Administrative violation, or some on-site damage. <br />(B) Little off-cite damage or moderate on-site damage. No health or <br />safety hazard. <br />(C) Little off-site damage or significant on-site damabe, and/or <br />possible health or safety hazard. <br />(D) Off-cite damage and/or significant health or safety hazard. <br />HISTORY OF VIOLATIONS IN PAST TWELVE MONTHS. <br />Operator was issued NOV f M-94-050 for unpermitted mining, at <br />another site (file ~ M-94-103). <br />~~+/L U~IO ~~ ; <br />Violation: Operator should be found in violation of CRS 34-32- <br />1 116(7)(f), for failure to adequately demonstrate the removal of <br />topsoil at the site occurred, and its segregation and protection <br />from erosion and contamination. <br />Cease and Desist: Operator should cease and desist all mining <br />operations in this permit until all corrective actions are <br />completed. <br />Corrective Actions: operator should perform the corrective actions <br />as set forth in the inspection report dated 9/13/94, except that <br />they will be completed by 9/23/95 (30 days from present). <br />Civil Penalty: The civil penalty may range from $50 to 200 per day, <br />~"~ considering the history, for a duration of 312 days. (This is from <br />~'V the corrective action date until the last day of abatement, 11/15/94 <br />to 9/23/95).
