Hartley and Steen: <br />On February 22, 1995, the Colorado Mined Land Reclamation Board ordered <br />that a separate permit for the Gold Hill Mill be issued by June 14, 1995. <br />As of this date, no such permit has been issued. We believe this <br />constitutes a violation of a Board Order and of Section 34-32-124 C.R.S. <br />On February 22, 1995, the Colorado Mined Land Reclamation Board ordered <br />that the remaining $4,500.00 portion of a $5,000.00 civil penalty be paid <br />on June 15, 1995 if a separate permit for the Gold Hill Mill had not been <br />issued. As of this date, the $4,500.00 civil penalty has not been paid. <br />We believe this constitutes a violation of a Board Order and of Section <br />34-32-124 C.R.S. - <br />Therefore, we have found reason to believe that two violations exist to <br />Permit M-83-141 and the law and have scheduled these matters before the <br />Mined Land Reclamation Board. <br />Formal Public Hearings will be held during the July 26-27, 1995 Board <br />meeting for consideration of possible violations. The hearings will be <br />held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at <br />9:00 a.m. or as soon thereafter as the matters can be considered and you <br />will have the opportunity to be represented and heard. It will be <br />reiterated that there is reason to believe that you are in violation of <br />the provisions noted above. <br />If the Board finds violations at these hearings, it may issue a cease and <br />desist order, assess civil penalties in the amount of $50.00 to $200.00 <br />for each day of each violation or order the permit to be suspended, <br />modified or revoked. In addition it may set these matters for <br />consideration of forfeiture of the $43,277.00 financial warranty at a <br />
