Emironmerital Engineer <br />SEP 1.7 2004 <br />Division N Minerals and CeolagY <br />RE: Request for Extension on Response to NOV No. CV-2004-001, from Colowyo Mine, Permit No. C-81-019 <br />Deaz Mr. Walker, <br />In response to Colowyo's recent NOV (No. CV-2004-001), Abatement Item 3b of the notice, Colowyo respectfully requests an <br />extension of 90 days to acquire additional information for [he Lease Modification application to BLM. In order to meet the <br />abatement requirement of the NO V, Colowyo must accomplish three sepazate items. These items are as follows: 1) Determine the <br />extent and amount of coal reserves, 2) Submit a Lease Modification to the BLM, and 3) Submit a Technical Revision to the CDMG <br />for mining and lease revision. <br />Calowyo personnel met with the BLM to preview Colowyo's Lease Modification application. BLM pointed out that Colowyo will <br />have to provide specific coal reserve information to cleazly identify which seams and quantity of coal will be the identified in the <br />lease. It was determined at that meeting that Colowyo would most likely have to do more drilling to provide the necessary <br />information, The drilling information would then have to be incorporated into the application. Colowyo is presently evaluating the <br />current reserve model in this azea and determining the extent of drilling that may be needed to fill reserve estimation adequacy far <br />the BLM as well as what seams would be tazgeted. <br />Colowyo will submit a lease modification to BLM as soon as adequate reserve estimates can be made. BLM has informed Colowyo <br />that the Lease Modification application process could take 3 to 6 months to get approval. 1n follow-up to the Lease Modification, <br />Colowyo will file a Technical Revision with the State to include the mining plans and new lease addition to the Mining Permit. <br />Therefore, due to the steps required to acquire the necessary information for the application, Colowyo requests a 90-day extension as <br />per the Colorado Mining Rules and Regulations regazding abatement. <br />Sincerely, <br />C.
