Notice of Violation <br />C-93-078: Permit C-82-056, Foidel Creek Mine <br />Per my discussion in the field with Mr. Berry this past week and <br />our subsequent telephone conversation, TCC proposes the following <br />steps to mitigate the impacts identified under the referenced NOV. <br />1) Pond B - As discussed, Pond B was hand-raked to remove the <br />materials spread during the culvert removal activities. TCC <br />proposes to leave the area as-is during this growing season to <br />allow established plant materials the opportunity for re-growth. <br />Should supplemental seeding of the area be required, such seeding <br />would be conducted this fall. <br />2) Pond T - Per our conversation, TCC proposes the following: the <br />wheel marks in the area of the Pond T topsoil pile will be smoothed <br />by backdragging and will be broadcast seeded, and the ruts near the <br />Pond T embankment will be smoothed by finger-raking the material <br />with the teeth on the backhoe bucket. Should this finger raking <br />with the backhoe prove too disruptive, hand labor will be used to <br />smooth the repair area.
