We do not consider <br />coal fines as being a regulated discharge of £ill material. However, the <br />clean up work will likely require permitting. I've included a permit <br />checklist and application, along with nationwide permit summaries for NW27 <br />and NW33. If the creation of the temporary catchment basin(s) can be <br />conducted via excavation only, i.e. without placing any material within the <br />stream or adjacent wetlands, the creation will not require permitting. The <br />restoration of the stream would require permitting. The catchment basin <br />should be placed outside of wetlands, to the maximum extent practicable, and <br />any wetlands that cannot be avoided should be excavated in such a way that <br />the top 12-18 inches of topsoil will be stockpiled seperately from the <br />sub-soil. During restoration the sub-soil should be placed first with the <br />topsoil spread back on top. In order to ensure a stable stream reach after <br />restoration, a longitudinal profile of the stream should be taken at the area <br />of the proposed catchment basin prior to excavation.
