THE MERITS OF BASIN'S MOTION'PO ADJUDICATE <br />BASIN'S CHALLENGE TO FORMER NOTICE OF V10LATION NO. CV-2000-009 <br />Pursuant to Colo. Rev. Slat. § 24-4-105(c), Anri Tatum and Jim Tatum (collectively, "the <br />l:attuns"}move to intervene in this proceeding for the limited purpose of objecting to this Board's <br />jurisdiction to decide the merits of the "Motion of Basin Resources, Inc., to Ilave Notice of V iolation <br />Adjudicated or, Alternatively, Vacated with Pmjudici' ("Basin's motion"). At this juncture, the <br />Talums do not seek to intervene with respect to any actual adjudication of the merits of Rasin's <br />motion that this Board may ultimately undertake, and they reserve the right to decline to participate <br />in any such proceeding or any subsequent proceedings before the is Board which purport to address <br />subsidence damage to the Tatums' residence known as "Solitario." The grounds upon which the <br />Tatums make this motion are the following: <br />the Tatums jointly own real estate in Las Animas County, Colorado, known as <br />"Solitario Ranch." <br />2. In ]997, the Tutums established through a judgment of the District Court of Las <br />Animas County, Colorado, that subsidence of abandoned underground mining workings in the <br />Golilcn Eagle mine, for which Basin Resources, Inc. ("Basin") is now legally responsible, caused <br />certain damages to the Tah[ms' adobe residence strueture at Solitario Kanch. <br />
