Dsc!, <br />1313 Sherman Street ~'f ~;a,u,,,~ ,,.. _, ., <br />Denver, CO 80203 <br />RE: Mined Land Reclamation Division's (MEAD) response to <br />Ten-Day Notice #84-2-032-8. <br />Dear Mr. Banta: <br />The Office of Surface Mining (OSM) has completed its review <br />of the Mined Land Reclamation Division's (MLRD) response to <br />the subject Ten-Day Notice. <br />Ten-Day Notice #84-2-032-8 was written to address Somerset's <br />storage of non-coal waste at their Elk Creek facility. The <br />areas did not appear to be designated for the purpose, nor <br />were they specifically designated as small area exemptions. <br />No alternative sediment control was in place, contrary to <br />statements contained within the approved permit package. <br />MLRD's response indicated the areas were shown on a map and <br />Somerset personnel submitted a minor revision clarifying the <br />area's use and drainage control. Upon review MLRD granted <br />specific small area exemptions. A state inspection of June <br />22, 1984 indicated that drainage controls were already in <br />place. Therefore since all concerns contained within TDN <br />#84-2-032-8 have been resolved, MLRD's response is <br />appropriate. <br />Sincerely, <br />Robert H.
