AFO considers <br />this a timely response to the TDN. <br />MLRD's response indicates that both violations cited in the TDN <br />constitute permit defects. MLRD also commits to notifying the operator <br />by letter no later than October 24, 1990, of the revisions required to <br />the existing permit; and require submittal of the revisions by November <br />30, 1990. MLRD will process the revisions within 10 days following <br />their receipt. <br />AFO finds MLRD has taken appropriate action to address the permit <br />defects by requiring the revision submittals within a specified time and <br />committing to processing the revisions in accordance with MLRD's <br />approved rules and regulations. <br />Therefore, AFO finds MLRD's response to TDN 90-2-116-4 (Violation Nos. 1 <br />and 2) to be appropriate. <br /> <br />
