Dear'`1s. Blake:
As you know, the Formal Public Hearing for the enforcement action regarding failure to provide
adequzte financial tarranty has been continued io the February 2~-26, 1998 monthly Board
1`4eeting. The hearing `>,°il] be held in Room 31 S of 1313 Sherman Street, Denver, Colorado,
besimting at 9:G0 a.m. or as soon thereafter as the matter czn be considered.
In order to resolve this enforcement action,, the current crate reclamation permit holder (Blake
Mining Co.) ~arill need to complete one of the follot~°ing options prior to the scheduled hearing
date:
1) Pro~ride to the Colorado Division of l~tinerals and Geology ("DMG") an acceptable .
financial t~rarranty in the amount of S21,S65.00. The form of the financial larranty
instrument must fully conform with one of the various types of bond instruments currently
acceptable to the DASG, namely: a) Check for Deposit in State Treasut}; b) Certificate of
Deposit; c} Irrevocable Letter. of Credit; or d} Corporate Surety.- In addition, the financial
warranty must be submitted along rarith properly filled out and executed D~4G bwtd forms
for the type of bond instrument selected. Also, the financial warranty must be submitted
to, reviewed, and accepted by the D\QG prior to the date of the hearing. In order to
provide DA-4G stzffwith sufficient time to review the financial warranty submittal, you ~arill
need to submit zhe financial warranty materials several davs prior to the scheduled hearins;

In the event the D?`dG permit holder ti-fishes to pursue having the D?\1G accept a Dept, of
Ener_ry ("DOE") bond in lieu of a DMG bond, the permit holder will need to provide to
the DMG, prior to the hearing. sufficient written Verification from the DOE that: a) The
entire ]0 acre area comprising the D\1G reclamation permit is fully covered by a valid
DOE lease; b) The current DOE lease holder is [he same eminr as the D~1G reclamation
