'.

Page Two
M. Long
1/15/97
We aze confident that Mr. Mueller will confirm that this is the case and he may be
able to shed some light with regazds to the recent mining activity.
Having said that, Adience Inc. fully intends to work with the State and resolve
issues that aze our obligations. It is our belief that the clay mine has remained
within the permitted 9.9 acre disturbance azea. However, since the State wishes
further qualification, we have secured the services of Valley Surveyors to provide
a survey and the boundary mazkers. Tom Schreiner with your office notified us
that the survey should be received by January 17, 1997. The surveyor is diligently
working to meet this deadline, but because of recent bad weather conditions, they
can not honor this date. We hope to have it completed by January 22, 1997 (the
original deadline); however, that also would be contingent on good weather. We
would hope the State would provide an extension to the deadline(s) setforth.
Adience Inc. respectfully requests the State to reconsider it's proposed
enforcement actions against us and grant an extension on it's receipt of the survey.
We have a permit for our mine activity, posted a $36,500 financial warranty and
will have the markers placed, as required However, we do not believe that we
should be held answerable for activity outside of ow clay interest.
Yours very truly,
Gary D.
