Inc. ("Pathfinder") and Public Service Company of Colorado ("Public <br />Service Company"), dated April 10, 1996, wherein Public Service Company grants Pathfinder <br />certain rights along the penstock right-of-way, more particularly described as follows: <br />A portion of Section 5, Township 41 North, Range 9 West and Section <br />32, Township 42 North, Range 9 West of the New Mexico Principal <br />Meridian, <br />County of San Miguel, State of Colorado. <br />Please provide me with a copy of the above-described Agreement at your earliest <br />convenience, but in no event later than September 15, 2000. You can send the Agreement to <br />me via facsimile. <br />Alternatively, if DMG does not have a copy of the signed Agreement, please notify me of <br />that fact, In writing, prior to September 15, 2000.
