Landowner: Ms. Edna Gardner <br />Commodity: Sand R Gravel County location: Routt <br />Method of Mining: Conventional Extraction <br />WAS THIS CASE THE RESULT OF A ROUTINE INSPECTION? YES <br />A routine inspection was conducted at the Gardner Gravel Pit by Erica Crosby and Gregg Squire of the Division. Field <br />measurementswere taken of the affected area boundary to determine if mining was taking place outside the permit area. <br />A CEASE AND DESIST ORDER WAS NOT ISSUED TO THE OPERATOR BECAUSE: <br />During the initial inspection it was determined that an updated map would be necessary to determine the exact size of the <br />disturbed area and to see if mining had occurred outside of the permit area. Therefore, the operator was required to submit <br />a surveyed map depicting the mining and affected boundaries. <br />DIVISION'S REASON FOR BRINGING THIS TO THE BOARD AS MINING WITHOUT A <br />PERMIT VERSUS MINING OUTSIDE THE PERMIT BOUNDARY <br />The operator was affecting more than two additional acres outside the permit area. <br />(DMG Policy -For any 1 ] 0 type operation, if the operator affects greater than two acres, the operator shall be found in <br />violation for mining without a permit. For all other permitted operations, mining without a permit shall be determined on <br />a case-by-case basis. Items to consider include the amount of disturbance, type of disturbance, ownership of the disturbed <br />area, impact to the surrounding area due to the disturbance, degree of any health or safety hazard). <br />NATURE OF UNPERMITTED (Construction Materials Exploration C.M.E. or Exploration Operation <br />E.O.) <br />Est.
