(303) 634-2020 <br />COMPLAINT <br />COMES NOW the Powderhorn Coal Company ("Powderhorn"), by and through its <br />attorneys, Snell 3r. 1Vilmer, LLP, and alleges as follows: <br />GENERAL ALLEGATIONS <br />1. Powderhorn is a debtor in possession, in a case administered with its Pazent, <br />Quaker Coal Company and l8 other subsidiaries, in the United States Bankruptcy Court for the <br />Eastern District of Kentucky. Powderhorn is incorporated in the State of Delaware. <br />2 Powderhorn owns two coal mines in N(esa County, Colorado, known as the <br />Roadside and Cameo Nlines ([he "Powderhorn Nlines"), which are subject to Permit No. C-1931- <br />041 ("Permit"), to conduct coal mining and reclamation operations. Approximately two-thirds of <br />the surface is Federally managed by the Bureau of Land Management. <br />3. Powderhorn acquired these mines on or about July l , 1997. <br />
