Canany <br />Division Diregor <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Fort Lupton Sand and Gravel Mine 112(c) Amendment (AM-01) <br />Application, File No. M-1999-120. The Division of Minerals and Geology ("Division") is required to make a <br />recommendation no later than January 10, 2005, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />The Applicant has supplied proof of public notice as required by Rule 1.6.5 (2). The following entities, however, appear <br />on [he Pre-Mining Plan Map but the Division has not yet received proof of notice for them: United Power, Xcel Energy, <br />Level 3 Communications, Qwes[ Corp., and Andesite Rock Company. Please submit proof notice to the identified <br />entities. <br />Rule 6.4.4 Exhibit D- Mining,Plan <br />2. The topsoil to be used for revegetation will need to be segregated and stored separately from the overburden material as <br />required by Rule 3.1.9(1). Please revise the Mining Plan Map [o depict [he locations of the topsoil and the overburden <br />stockpiles. <br />3. The applicant notes that during the operation, excavation of dewatering trenches, sedimentation ponds and sump areas <br />will occur. Please provide additional detail regarding the constmction, use and management of these structures and <br />include them on the Mine Plan Map, Exhibit C-3, <br />4. The applicant states that the entire site will be graded to direct storm water runoff towards ditches and dewatering <br />systems. Please specify the dimensions and location of these ditches on the mine plan map. <br />Rule 6.4.5 Exhibit E -Reclamation Plan <br />5. Please state how much mulch per acre will be applied should mulch be required for revegeta[ion. <br />6. The Division received comments regazding reclamation of the site from the Natural Resources Conservation Service <br />dated November 18, 2404. A copy of this letter was faxed to [he Applicant. Please address any issues contained in [his <br />letter that conflict with the proposed reclamation plan for the site. <br />Rule 6.4.7 Exhibit G -Water Information <br />7. The applicant should be aware that 3.1.6 (I) of the Construction Material Rules and Regulations requires [hat <br />disturbances to [he prevailing hydrologic balance of the affected land and to the surrounding area and to the quantity and <br />quality of water in surface and groundwater systems both during and after the mining operation and during reclamation <br />shall be minimized.
