As the <br />record reflects, the engineer on three occasions, July 31, August 9 <br />and August 13, attempted to certify the pond's completeness. The <br />August 9 letter reflected that an adjustment in the spillway height <br />would have to be made to meet the criteria of a "one-foot free- <br />board." However, he did not indicate that the spillway as then <br />constructed would not serve its intended purpose. IrE fact, on <br />July 31, 1990, Allen stated, "The pond retains its integrity and no <br />fundamental change in the original certified design has occurred. <br />The pond still appears fit for its purpose of site storm water <br />detention." <br />My client was not aware until August 23 that the MLRD <br />considered the NOV still unsatisfied. On August 29, Cap Allen <br />furnished a further supplement that the spillway was in confor- <br />mance. He sent another letter on September 13 restating his <br />position of August 9 that the pond was in compliance with the <br />stabilization standards of the regulation. <br />Substantial time intervened during the exchange of letters and <br />we do not believe this time should be charged against Blue Flame <br />for penalty purposes. Although the Certification by the engineer <br />was technically deficient, it is his opinion that the sediment <br />
