For your information, I have enclosed recommendations made by Jim Pendleton regarding the installation of electronic tiltmeter tubes downslope from the toe of the proposed upper waste pile before construction. 12(1). A. According to page 2.05-61 and 2.05-62, the refuse pile monitoring wells are sampled seasonally and will be sampled for the water quality parameters on Table 54 (page 2.05-65). Becuase the chemical constituents required in Stipulation 8 are included in Table 54, this stipulation will be terminated. A stipulation will be attached to the approval of West Elk's permit which states that the as built designs for the stack tubes, the amount of gob utilized for the fill, the drainage configuration, including the location of clean water ditches, sediment ditches, sediment trap and culverts, contours of storage pad, and the final maps from technical revision no. 58 should be provided by December 30, 1992. In addition to the above items, we had a phone conversation on June 24, 1992, in which I detailed three additional items which should be included in West Elk's renewal responses. The first is a designation of the area below MB-5 as a small area exemption because the flow does not go to the pond and goes off site. In relation to this, I asked for an updated map of the Bear ~1 area that contains this pond. This will be stipulated and should be addressed by December 30, 1992. The second item was simply a correction on page 2.05-94. The second paragraph reads "Table 58 is a schematic..", and it should read "Figure 16 is a schematic...". Because this a simple change, it should be submitted with the other required responses in this letter by December 11, 1992. The third item is the MSHA Refuse Pile Fire Fighting Plan. This requirement was also detailed in my August 26, 1992 letter. This information should be submitted as a new exhibit and referenced in the permit by December 11, 1992.
