<br />,• <br />Renewal Adequacy 2 <br />Page 4 <br />8. Stipulation 17 will be terminated because revised page 2.04-147 <br />incorporates the requirement. <br />9. Your clarification regarding stipulation 19 from permit <br />revision is noted. Stipulation 18, which replaced No. 19, will <br />remain as future. <br />11. Stipulation 7 will remain in future status. For your <br />information, I have enclosed recommendations made by Jim <br />Pendleton regarding the installation of electronic tiltmeter <br />tubes downslope from the toe of the proposed upper waste pile <br />before construction. <br />12(1). <br />A. According to page 2.05-61 and 2.05-62, the refuse pile <br />monitoring wells are sampled seasonally and will be <br />sampled for the water quality parameters on Table 54 (page <br />2.05-65). Becuase the chemical constituents required in <br />Stipulation 8 are included in Table 54, this stipulation <br />will be terminated. The other stipulation requirements <br />have also been incorporated into the permit, with the <br />exception that quarterly hydrology reports are no longer <br />required. <br />B. See response in A above. <br />16. A stipulation will be attached to the approval of West Elk's <br />permit which states that the as built designs for the stack <br />tubes, the amount of gob utilized for the fill, the drainage <br />configuration, including the location of clean water ditches, <br />sediment ditches, sediment trap and culverts, contours of <br />storage pad, and the final maps from technical revision no. 58 <br />should be provided by December 30, 1992. <br />In addition to the above items, we had a phone conversation on June <br />24, 1992, in which I detailed three additional items which should <br />be included in West Elk's renewal responses. The first is a <br />designation of the area below MB-5 as a small area exemption <br />because the flow does not go to the pond and goes off site. In <br />relation to this, I asked for an updated map of the Bear ~1 area <br />that contains this pond. This will be stipulated and should be <br />addressed by December 30, 1992. The second item was simply a <br />correction on page 2.05-94. The second paragraph reads "Table 58 <br />is a schematic..", and it should read "Figure 16 is a <br />schematic...". Because this a simple change, it should be <br />submitted with the other required responses in this letter by <br />December 11, 1992. The third item is the MSHA Refuse Pile Fire <br />Fighting Plan. This requirement was also detailed in my August 26, <br />1992 letter. This information should be submitted as a new exhibit <br />and referenced in the permit by December 11, 1992. <br />
