I. FACTS SURROUNDING THE VIOLATION:
Energy Fuels estimates that there is approximately 4 truckloads of non-coal waste located east of the
refuse pile and north of the water tank. This material is primarily located in the corner of the boneyazd
against the highwall, left there by Sundance Coal Co.
The other three areas referenced in the NOV contain only minor amounts of what may be
considered non-coal waste: unused mining supplies, empty oil drums (placed in the SPCC containment
area), and pieces of structures being removed for reclamation.
