'• <br />8. T'he Bureau of Land Management has denied Mr. Hoyl's request fora 5 year extension <br />to the federal coal leases, Mr. Hoyl is appealing this denial. <br />9. Mr. Hoyl is objecting to the abatement of NOV C-90-030 until a decision is reached <br />on his appeal for an extension on his coal leases. His appeal, if successful, would <br />allow him time to possibly find an interested mining company to permit and reopen the <br />mine, Also reclamation of the mine will increase to an extent the startup cost of a <br />new mine. <br />10. Reclamation will not prevent future development of the mine and will serve to <br />stabilize the site until a mine is constructed. <br />CONCLUSIONS OF LAW <br />Under the terms of C.R.S. 34-33-124(1) and Rule 5.03.5(1)(a) of the Regulations of <br />the Colorado Mined Land Reclamation Board, any person having an interest which is or <br />may be adversely affected by the issuance of a notice of violation may request a <br />review by the Boazd. <br />BOARD ORDER <br />Based on the foregoing Findin of Fact, Conclusions of Law and pursuant to the <br />provisions of C.R.S. 34-33-124c1(2)&(3), the Boazd hereby orders that no action be <br />taken to postpone the abatement of Nouce of Violation C-9 -030. <br />Date: ~ /~iS~~ <br />RPP/rpp <br />
