Box 783 <br />Trinidad, Colorado 81082 <br />DIVISION <br />Re: Request for Extension of March 31, 1984 Deadlines Contained on NOV's <br />CV-84-027 and CV-84-029 <br />Dear Mr. Mills: <br />The Division cannot grant your request for extension of the March 31, 1984 <br />deadlines contained 1n NOV's CV-84-027 and CV-84-029 for the following reason: <br />The Division is particularly concerned with proper containment and detention <br />of water from disturbed areas. Given that the Trinidad area has received <br />large amounts of winter precipitation this season, the Division 1s especially <br />concerned that the sediment control system and road drainage structures are 1n <br />good condition and functional prior to the initiation of spring melt and <br />runoff. To delay correction of problems with these systems will only Increase <br />the possibility that they may not be in adequate condition to handle this <br />spring's runoff. <br />As further point, let me remind Trinidad Basin that failure to meet the <br />abatement deadlines set forth 1n the Notices of Violation will result in <br />minimum civil penalty of 5750.00 per day for each day the violation(s) remains <br />unabated. <br />If you have any questions or if I can be of any further assistance please feel <br />free to call. <br />Sincerely, <br />Michael S.
