These spills occurred during the month of March, <br />1999. This NOV is also being issued in conjunction with a CDMG inspection of the Foidel Creek Mine <br />conducted on April I, 1999, and laboratory anal}•ses provided by TCC [o the Division subsequent to [he <br />spills that indicate that the quality of this mine water exceeded certain federal effluent limits in both <br />instances. <br />The Division has requested as part of the abatement of this NOV the submittal of a Technical Revision to <br />revise the CDMG Foidel Creek Mine Permit. As discussed in a meeting between representatives ofTCC <br />and the Division on April 6, 1999, the Division believes this is necessary so that the permit sections that <br />address the probable hydrologic consequences of mining and the impacts to the hydrologic balance are <br />revised to refect [he current and future hydrologic regime within and adjacent to the permit area. The <br />Division believes this is also necessary so that the designs for any underground mine water discharge <br />treatment systems reflect both oFthese hydrologic scenarios. <br />Additionally, [he Division is in the process of reviewing Twentymile Coal Company's application for <br />renewal (RN-03) of the Foidel Creek Mine permit. The Division hopes to approve the application for [he <br />reneYVal prior to approving [he application for the above-mentioned Technical Revision. <br />We appreciate the cooperation of Twentymile Coal Company in this matter.
