SECONDED <br />and PASSED UNANIMOUSLY. <br />This entire presentation can be heard on the permanent record, Tape 1 @ 63. <br />AGENDA ITEM 9 - FORMAL PUBLIC HEARING, SCHMIDT-TIAGO, 79-188 <br />All persons wishing to give testimony in this matter were sworn by the <br />Chairman. <br />Staff presentation was made by Reclamation Specialist, Jim McArdle, requesting <br />continuance because of insufficient notification to the operator regarding <br />this formal public hearing. <br />It was MOVED that the Formal Public Hearing regarding Schmidt-Tiago, File No. <br />79-188 be continued to the November Board Meeting. SECONDED and PASSED <br />UNANIMOUSLY. <br />SUNSHINE ITEM 9 - RUNYAN SAND & GRAVEL COMPANY, 77-541 <br />Staff presentation was made by Reclamation Specialist, Jim McArdle, regarding <br />a 44 acre sand and gravel operation located just west of Rifle, Garfield <br />County. The operator has requested a 30-day extension of the reclamation <br />timetable. Staff gave a brief history of the mine site and the activity which <br />lead to the submission of the reclamation timetable. <br />This presentation can be heard on the permanent record, Tape 2 @ 51. <br />It was MOVED that the Board approve a one month (30-day) extension as <br />requested by Runyan Sand & Gravel. SECONDED and PASSED UNANIMOUSLY. <br />BOARD MEMBER, Terry O'Connor, left the Board Meeting. <br />AGENDA ITEM I1 - FORMAL PUBLIC HEARING. DAVID CONEY. 79-62 <br />All persons wishing to give testimony in this matter were sworn by the <br />Chairman. <br />Staff presentation was made by Mineral Supervisor, Ed Bischoff, regarding a <br />.05 acre placer operation in Gunnison County. Staff recalled for the Board <br />that at the September Board Meeting the Board found reason to believe that a <br />violation of the permit had occurred for failure to pay annual fees and submit <br />annual reports for five years. Staff recommended that the Board find a <br />violation for failure to submit annual fees and annual reports, issue a cease <br />and desist order and order corrective action of payment of the annual fees and <br />submit annual reports and set the matter for formal public hearing at the <br />December Board Meeting for consideration of civil penalties. <br />
