<br /> <br />AGREEMENT FOR ENVIRONMENTAL <br />CONSULTING SERVICES <br />THIS AGREEMENT is made as of this _ day of a99_, by and <br />between BATTLE MOUNTAIN RESOURCES, INC. ("BMRI"), a corporation <br />with offices at 333 Clay Street, 42nd Floor, Houston, Texas 77002-4103 and at 5670 <br />Greenwood Plaza Boulevard, Suite 106, Englewood, CO 80111 and RCG/Hag}er, Bailly, Inc. <br />("Consultant"), a corporation with offices at P.O. Drawer O, <br />Boulder, Colorado 80306. <br />WHEREAS, BMRI is subject to a Notice of Violation and Order issued by the <br />Colorado Mined Land Reclamation Board ("CMLRB") dated May 28, 1992, tjy which BMRI <br />is required to engage a consultant to conduct independent sampling of cert~in monitoring <br />points associated with the tailings facility at a gold mine BMRI operates in dostilla County, <br />Colorado pursuant to CMLRB Permit No. M-88-112; <br />WHEREAS, BMRI and the Colorado Division of Minerals and Geology ("DMG") <br />have entered into a Memorandum of Understanding which sets forth their respective <br />responsibilities and establishes a framework for the implementation of the required third <br />party monitoring; <br />WHEREAS, BMRI concurs with DMG's selection of Consultant to c~llect, preserve <br />and ship samples to an analytical laboratory to be specified; <br />
