Cattany <br />Acting Division Director <br />Hello, and thank you for your letter of July 3, 2002 requesting a partial vacation of DMG Notice <br />of Violation (NOV) CV-2002-008. <br />This NOV was written for failing to conduct approved water quantity and quality monitoring at <br />the Golden Eagle Coal Mine. The NOV consists of six parts. Parts 1 and 2 aze not being <br />contested, and Parts 3, 4, 5 and 6 aze the subject of the vacation request. Of the four parts being <br />requested for vacation, DMG staff support vacation of Part 3, but not of Parts 4, 5, and 6. <br />Protecting Colorado's water resources from the possible adverse effects from coal mining is a <br />important responsibility of the Division of Minerals and Geology. In order for the Division to <br />perform this function, coal mine operators must do all that they can to work with owners and <br />operators of wells to ensure that water monitoring programs, including obtaining and analyzing <br />water samples, and providing those analyses to the Division, are conducted as approved. <br />Based upon the information provided to date, therefore, the request to vacate Part 3 of this NOV is <br />approved, but the request to vacate Parts 4, 5, and 6 is denied. Should new information come to <br />light that may have a bearing on this decision, please feel free to re-submit your request. <br />S' erel , <br />Ronald W.
