Long <br />New York, NY 10270 Division Director <br />RE: Corporate Surety Bond No. 13-20-11 <br />Proposed Decision to Approve, Phase I Bond Release, <br />Kerr Coal Company, Marr Mine, Permit No. C-80-006. <br />Dear Ava Walker: <br />Please find enclosed, the Colorado Division of Minerals and Geology's (DMG) proposed <br />decision to approve the Phase I bond release request for the Marr Strip Mine. Kerr <br />Coal Company, the owner, operator, and permittee of the Marr Strip Mine, requested <br />the bond release for reclamation work completed in accordance with their approved <br />reclamation plan. The DMG proposes to release $2,171,216 of the $5,500,000 corporate <br />surety bond, number 13-20-11, that Kerr Coal Company holds with National Union Fire <br />Insurance Company of Pittsburgh, PA. <br />I have also enclosed a copy of our public notice, to be posted in the Jackson County <br />Star. As stated in Rules 3.03.2(5)(c) and (6)(a), if the DMG does not receive a written <br />request for adjudicatory hearing within 30 days from the date of the first publication of <br />our proposed decision, our proposed decision will become Cinal. <br />Please contact me if I can be of further service. <br />Sincerely, <br />Wallace H.
