~l
Mr. Michael B. Long, Director
December 13, 1999
Page 2
undependable to get the work started. Rip-rap material for this
project had been delivered to the site in early 1998 in anticipation
of starting the work.
Considering that EFMC recently received the above referenced
violation for not completing the scheduled work, and the fact that
the contractor was ready to leave the site to do work elsewhere, EFMC
felt compelled to start the work proposed in the minor revision. The
contractor s other work was even delayed in order to do repair of two
subsidence holes and make ditch repairs subject to comments made in
recent inspection reports. With the limited availability of the
contractor on site and impending winter weather, EFMC diligently
proceeded with all the work necessary for completion during the
construction season.
Issuance of this violation on the basis of proceeding with proposed
work prior to approval of a minor revision is not warranted. The
above information provides that EFMC was acting to diligently
complete reclamation activities requested by the Division. In
conclusion, EFMC requests that Notice of Violation CV-99-014 be
vacated.
Sincerely,
Energy Fuel Mining Company
~2L /
Allen S. eaver
Mine Engineer
cc: G. V. Patterson (EFMC)
Kent A. Gorham (DMG)
