Rip-rap material for this <br />project had been delivered to the site in early 1998 in anticipation <br />of starting the work. <br />Considering that EFMC recently received the above referenced <br />violation for not completing the scheduled work, and the fact that <br />the contractor was ready to leave the site to do work elsewhere, EFMC <br />felt compelled to start the work proposed in the minor revision. The <br />contractor s other work was even delayed in order to do repair of two <br />subsidence holes and make ditch repairs subject to comments made in <br />recent inspection reports. With the limited availability of the <br />contractor on site and impending winter weather, EFMC diligently <br />proceeded with all the work necessary for completion during the <br />construction season. <br />Issuance of this violation on the basis of proceeding with proposed <br />work prior to approval of a minor revision is not warranted. The <br />above information provides that EFMC was acting to diligently <br />complete reclamation activities requested by the Division.
