Box 2379 <br />Colorado Springs, Colorado 80901 <br />RE: Castle Concrete Company, Snyder Ouarry, El Paso County <br />MLRO Permit No. M-77-210 <br />Dear Mr. Morgan: <br />On July 6, 1989 we conducted an inspection of your mine and found off-site <br />impacts due to rock slides at the drainage between the existing Phase I and <br />the proposed Phase III areas. Off-site impacts were also found along the <br />quarry access road. <br />We believe this is in violation of Sections 34-32-116(7)(8), (h), and (i) of <br />the Colorado t4ined Land Reclamation Act. <br />Therefore, we have found reason to believe a violation exists to Permit <br />M-77-210 and the Law and have scheduled this matter before the Minec! Land <br />Reclamation Board. <br />A Formal Public Hearing will be held during the August Z3-24, 1984 E3oard <br />meeting for consideration of possible violation. The hearing will be held in <br />Room 220 of 1313 Sherman Street, Denver, Colorado, beainninD at 9:OD a.m. or <br />as soon thereafter as the matter can be considered and you will havE~ the <br />opportunity to be represented and heard. It will be reiterated tha~: there is <br />reason to believe that you are in violation of the provisions noted above. <br />If the Board finds violations at this hearing, it may issue a cease and desist <br />order, assess a civil penalty in the amount of 5100.00 to 51,000.00 for each <br />day of violation or order the permit be suspended, modified or revo<ed.
