TO: NELSON CONTRACTORS, INC. and all other persona
presently owning or acquiring now or in the future
andinterest in NELSON CONTRACTORS, INC.
FINDINGS OF FACT
Pursuant to the authority vested in the.Hined Land Reclamation
Board by C.E.S. 19730 34-32-1239 as vended, (1976 Session Laws, H.B. 1065)
the Board hereby mares the following findings of fact:
1. NELSON CONTRACTORS, INC. Is operating a sand and gravel
mining operation in the following location: Part of the SW 1/4 of
Section 321, T6S, R71V of the Gth P.H., Jefferson County. Colorado.
2. Sand and gravel operations an required to be permitted by the
Board pursuant to the terms of Article 32 of Title 340 C.R.S. 1973, as
amended (1974 Session Laws, N.B. 1065).
3. NELSON CONTRACTORS, INC. .has net obtained a permit for
sand and gravel mining operation.
NOTICE OF VIOLATION
You are hereby notified that the facts stated above constitute a
violation of Section 109 My Article 320 Title 34, C.R.9 1973, as amended.
This section provides in pertinent part:
An operator shall obtain a development and extraction permit from
the Board for each mining operation.
The term operator is defined by C.R.S. 1973, 34-32-102 to include:
any parson, firm, partnership, association or corporation or any department,
division, or agency of federal, state, county or municipal government engaged
in or controlling a mining operation.
