Even with this <br />improvement, however, there remain three unresolved adequacy issues that must be <br />addressed before the application can be approved. These are outlined below. <br />Exhibit A <br />It is clear to the Division from the application what property the City intends to be included <br />in the permit area, but the City's ownership of this tract of land or its right to mine this <br />tract by reason of a lease has still not been provided. The proof of ownership provided in <br />this adequacy response applies to the 6 acre tract immediately west of the orooosed <br />g_ermit area not to the property within the permit area. <br />The City must provide evidence of right of entry to the land that is intended for mining <br />and for inclusion in the permit area. <br />Exhibit B -Part 3 <br />Contrary to what the application says, there appears to be an element of water resources <br />in the area. The Soil Conservation Service maps indicate a linear pond, stream, or ditch <br />cutting through the permit area. Some water body was also evident to the inspector <br />during the Division's initial inspection of the site. <br />COLORADO <br />If there is such a body of water in the area, it should be mentioned under Exhibit B. If it is <br />not to be disturbed by the mining or if it will not receive drainage form the area affected <br />by the minirig, that too should be indicated under Exhibit B. <br />
