Mr. Robert Hagen - 3 - June 12, 1991 <br />The use of alternative sediment control practices as allowed by the Colorado <br />Rules achieves the goals of 30 CFR 816.45. The structures in question are <br />permissible under both Colorado regulation and 30 CFR 701.5 and 816(b)(6). <br />Colorado has required the appropriate implementation of the Rules such that <br />compliance with the State and Federal programs is assured. Therefore, we <br />request that the Deputy Director determine that our response is neither <br />arbitrary or capricious and thus should have been determined to be appropriate. <br />Please feel free to contact me if you have questions or comments. <br />Sincerely, <br />Steven G.
