NOV C-95-012 <br />Bowie Mine No. 1 <br />This NOV was issued for failure to maintain sediment ponds. <br />HISTORY <br />Two NOV's have been issued at this site during the past twelve <br />montk~ (NOV C-94-038 and 95-004). NOV 95-004 is still in the <br />administrative appeal process. $50 is assessed for history. <br />SERIOUSNESS <br />Failure to maintain the discharge structures on the ponds cited in <br />the NOV led to discharges of storm runoff from the pond which were <br />evidently not planned, since the control gate on the discharge pipe <br />was closed. Pictures from the inspection indicate water <br />discharging from the ponds was very muddy; however, lab results <br />from analyses of the discharge are not available at this time. <br />The intent of the ponds is to minimize sediment contributions to <br />streams. The failure to maintain the ponds increased the potential <br />for unpermitted discharges and appears to have resulted in an <br />unknown quantity of sediment leaving the sediment control system. <br />$500 is assessed for moderate seriousness. <br />FAULT <br />The problems observed by the Division inspector should have been <br />apparent to the operator prior to the inspection. Maintaining <br />sediment ponds in working order is a fundamental part of the <br />preventative measures required by the coal regulations. $500 is <br />assessed for negligence. <br />GOOD FAITH <br />There is no evidence of good faith in the file at this time, and <br />the NOV has not yet been abated or terminated. Therefore, good <br />faith is not relevant at this time. <br />c:\wp51\061495 <br />
