Moms/Anderson <br />March 12, 2001 <br />Page 2 <br />The Notice of Violation is also vacated based upon our understanding that there aze no <br />allegations of environmental damage, of damage to any resources of the State, or of any <br />imminent threat to human health and safety. Additionally, the complainant has <br />specifically chosen to pursue the allegations of damage to their private residence and <br />property by judicial, rather than administrative process. <br />Therefore, based upon all of the circumstances of this case, all parties aze advised that the <br />Division of Minerals and Geology has vacated this Notice of Violation without prejudice <br />at the request of the complaining party. Based upon the statements made in the March 8, <br />2001 letter from Counsel for Jim and Ann Tatum, it is highly unlikely that this agency <br />would address this matter in the future. This matter will be withdrawn from the March <br />21-22, 2001 agenda of the Mined Land Reclamation Boazd.
