ADDENDUM TO NOTICE OF VIOLATION <br />Notice of Violation No. C-95-023 <br />The channel which has been reconstructed is the reclaimed portion of the Pit B area is a <br />straight (no apparent deviation from perpendicular to slope) channel, with a lame section <br />lined with rip rap. The channel runs in a northeast to southwest direction. This channel <br />ends at the uppgradient end of the unreclaimed portion of Pit B. The linear extent of the <br />constructed drunage is approximately 1200 feet. <br />The approved postmining topography, as shown on Exhibit 20-2 to the Seneca II-W Mine <br />permit application, indicates two maJJor drainages will be reconstructed in the B Pit area. <br />Those drainages, 006-NE 1 and 006-NE 2, are to be located in the approximate locations <br />of premising channels. 006-NE 1 should be a meandering channel located in what is <br />currently the open portion of Pit B. 006-NE 2 should run northwest to southeast for <br />approximately 1000', beginning in the upper Pit B, and then meander in a south to <br />southwest direction, through Pit A, existing 006 Gulch, and into Pond 006. The existing <br />reconstructed drainage is not in the approved location of either proposed channel, and <br />permanent reclamation (topsoil redistribution and permanent seed mix application) has <br />occurred. <br />The approved permit application, in Volume 13, Tab 20, pages 8 and 9 states that all major <br />drainages disturbed by rmmng will be reclaimed to the approximate premising configuration. <br />It further states that channels will be reclaimed to establish or restore the natural <br />meandering patterns with stable gradients. The constructed drainage does not meet these <br />criteria. <br />The design for drainages 006-NE 1 and 006-NE 2 is based on a vegetated channel. The <br />application states that methods used to stabilize channels could [emphasis added] include <br />installation of approved [emphasis added] check dams and livestock ponds. erosion control <br />matting, rid raQ, and straw dikes. The Division has not granted approval for the installation <br />of rip rap in either channel, nor has the operator submitted any such proposal. <br />
