WFU promptly abated the NOV by submitting certified
copies of pond inspections and it has been terminated by DMG. The Assessment Officer agreed
to consider the seriousness as 'administrative' and give credit for "good faith' compliance.
The first part of the NOV (ditch maintenance) was abated promptly. WFU has requested that the
second part of the NOV be modified as to the requirement for riprapping the ditch. A technical
revision application has been submitted in this regard. The Assessment Officer agreed to give credit
for "good faith" compliance of the first part of the NOV.
The Assessment Officer is willing to vacate this NOV if WFU could show that sediment control from
the following areas had been addressed in the permit: radio tower, transfer station, staging areas
near slot storage and conveyor belt, and near transfer 1, and degas and sump-dewatering wells.
Suite #305
405 Urban Street
Like+~ood, Colorado S022S
Telephone ;O;ry88 ~96?6
Telecopier 3086-8147
