I have attached a copy of th MLRB's <br />July 24, 1991 order authorizing reclamation activities t the <br />site. The Division has reviewed your additional financ al war- <br />ranty and, having found it to be acceptable, hereby aut orizes <br />the resumption of mining operations at the site. <br />I note that, although the site is now adequately bonded there <br />remain several discrepancies between the state of affai s at the <br />site and the provisions of the permit. In order to res lve this <br />problem, the Division will ask the Board to modify your permit <br />pursuant to § 34-32-124(6), C.R.S. when it holds the he ring to <br />reconsider the civil penalty. Pursuant to your request, the <br />hearing will be held on November 13, 1991 at 1313 Sherm n Street, <br />Denver, Colorado, Room 318. The Board meeting will con ene at <br />8:30 a.m. Please feel free to contact me on November 11, 1991 <br />for more specific information on the time of the hearing. <br />The Division proposes the following permit modifications: <br />1. The addition of a provision requiring the oper for to <br />keep the pit dry until the sides have been graded 'n com- <br />pliance with Rule 6.1(6), 2 CCR 407-1; <br />2. The deletion of the provisions requiring Conti uous <br />reclamation, limiting the area unreclaimed disturb nce to <br />11.5 acres, and requiring the redistribution of to soil <br />
