Although the road was constructed <br />within a permit area, the actual ground impacted was p[evlously <br />undisturbed. While the Division is aware that certain on-site <br />conditions may be encountered that may esquire minor diversions <br />from the approved plan, it is not clear in this case that the <br />additional disturbance was absolutely necessary. In this <br />instance, the basic assumption that disturbance to the <br />environment has been minimized is not cleat. <br />For the reasons I have outlined, the Division rise determined <br />that the facts of the violation should stand. <br />If you wish to have a conference on the facts of the violation, <br />the attached Request for Conference form must be mailed to the <br />Division within 10 days of receipt.
