Welcher <br />Executive Director <br />Ronald W. Cattany <br />Acting Division Director <br />The Division received your response to the Division's third adequacy letter. Following aze a few <br />concerns which still have not been resolved/addressed: <br />3. As you recall, item 3 of the third adequacy letter requested that you correct page 2 of the <br />application form and re-submit it. Make sure the location of the site is correct before re- <br />submitting (the site is located in Section 27, T9S, R64W). <br />7. A new Exhibit E was not included in your latest response as requested in the third adequacy <br />letter. In addition, you did not submit the NRCS seed mixture, nor did you commit to the existing <br />approved seed mix. Nor did you commit to adding Prairie Junegrass to the mix. If you will just <br />commit to following the existing approved reclamation plan, and the existing approved seed mix <br />(but add Prairie Junegrass), it will make it easier. You would not have to submit a new Exhibit E, <br />just the recommended seed rate for the Prairie Junegrass. <br />12. Exhibit S -once again, you must comply with section "a", "b", or "c" of Rule 6.4.19 for the <br />identified power line. The two way agreement between Q-west phone service and Elbert county <br />complies with Rule 6.4.19 so a similaz agreement with Mountain View Electric would be okay. <br />I can not find the most recent proof of publication in the file. As you recall, Elbert county had to <br />re-publish because of an error in the original publication. As a result, Elbert county was required <br />to submit a copy of the second publication to the Division and to, notify all owners of record of <br />the affected land and to all owners of record of surface lands that are within 200 feet of the <br />boundary of the affected land (pursuant to Rule 1.6.2(1)(g)) and send the Division proof that the <br />owners were notified. <br />The 365 day review period expires on September 12, 2002. If the application stilt has <br />outstanding issues after the 12a', the Division will set the matter for a Mined Land Reclamation <br />Boazd meeting. At the hearing, the Board may deny or approve the application. <br />If you have any questions, please give me a call at 303-866-4060. <br />
