Long
Division Direnor
I have reviewed your request for vacation of Notice of Violation
No. C-93-008. Based upon the record, it is my understanding that the
Division could not locate the documents in question within the mine
files, but they subsequently were located by another individual. The
intent of the regulations in this regard is to insure that all
pertinent mine documents are readily available for public inspection.
I am concerned that if the Division could not locate the documents,
that the public would also not be able to do so. It is also unclear
from the record where these documents were finally located, and
whether they were in the same file box as the rest of the mine
documents. Therefore, I must decline to vacate the Notice of
Violation at this time. I do, however, encourage you to request an
assessment conference so that you may make your case to an impartial
Assessment Officer.
Please contact David Berry
questions or comments.
Sincerely,
Michael B.
