Lamm <br />Governor <br />March 21, 1985 _ <br />Mr. Robert Hagen <br />Office of Surface Mining <br />219 Central Avenue, NW <br />Albuquerque, New Mexico 87124 <br />Re: Ten-Day Notice 85-2-244-5 TVl <br />Dear Mr. Hagen: <br />The Division received Ten-Day Notice (TDN) 85-2-244-5 TV1 on March 14, 1985. <br />The TDN was written tG the Twin Pines Mine for failure to change permits <br />(County Special Use, NPDES, and Air Emissions) to apply to the appropriate <br />controlling business entity (Rule 2.03.4(4)) <br />Rule 2.03.4(4) is a permit application requirement for a list of all other <br />permits or pending applications which are related to the operation. The <br />regulations do not require the documents to be on file at the mine or the <br />Division. Nor do the regulations give the Division the jurisdiction to ensure <br />that these permits are on file and in force.
