<br />BEFORE THE COLORADO MINED LAND RECLAMATION BOARD <br />COLORADO DEPARTMENT OF NATURAL RESOURCES <br />SECOND REQUEST TO POSTPONE HEARING IN REGARD TO APPEAL OF OFFICE <br />DECISION TO DENY REQUEST FOR ACREAGE REDUCTION <br />IN THE MATTER OF PERMIT M-1987-049, AR-002 <br />READY MIXED CONCRETE COMPANY <br />By letter to the Office from Brierley & Associates dated December 6, 2004, this firm's <br />client, Ready Mixed Concrete Company ("RMCC"), requested that the area covered by Permit <br />No. M-1987-049 for its Bromley Lakes operations be reduced in size. The Bromley Lakes <br />property is owned by the City of Brighton ("City"). RMCC owns, and is in the process of mining, <br />the sand and gravel from the property. <br />DMG representatives inspected Cell 1 on Tuesday, December 7, 2004 and subsequently <br />denied the request by letter to RMCC of the same date. RMCC caused to be filed on December <br />7, 2004 an Appeal of Office Decision to Deny Request for Acreage Reduction. RMCC further <br />requested that the matter be placed on the Mined Land Reclamation Board's ("Board's') <br />meeting agenda for Tuesday, December 14 or Wednesday, December 15, 2004, which matter <br />was thereafter scheduled to be heard by the Board at its December meeting. <br />On December 9, 2004, RMCC learned that the City of Brighton (the landowner) <br />preferred that the hearing on RMCC's appeal be postponed to the Board's January 19-20, 2005 <br />meeting. Based on the City's expressed preference, RMCC requested that the hearing be <br />rescheduled and placed on the Board's January meeting agenda. The Board accommodated <br />RMCC's request. <br />RMCC and the City continue to discuss issues related to the requested acreage <br />reduction, which issues relate to the City's desire to construct a lined water storage reservoir in <br />Cell #1 on the Bromley Lakes Property. RMCC believes the parties will be in position to jointly <br />address the Board at its February 2005 meeting, and RMCC requests that the hearing be <br />rescheduled and placed on the Board's February agenda. <br />Respectfully submitted this 18th day of January, 2005 <br />Ready Mixed Concrete Company <br />By---------- <br />Jeffrey W.
