Long <br />Division Director <br />Re: Civil Penalty Assess ent For Raton Creek Mine C-82-055 <br />NOV C-95-018 <br />NOV-C-82-055 was written to Energy Fuels Mining Company, on June 14, 1995, for <br />operations at the Raton Creek Mine (C-82-055), for failure to protect topsoil from erosion <br />after redistribution, failure to conduct seeding and planting operations, and failure to <br />conduct soil stabilization practices as approved by the Division. <br />Events leading up to Issuance of NOV-C-95-018: <br />Energy Fuels conducted backfilling and grading operations spring through fall 1994. Topsoil <br />was applied on portions of the mine regraded mine site and recontoured refuse pile. The <br />Raton Creek Mine site has a deficit of topsoil. Approx. 4" topsoil was applied on part of <br />the mine with 17.1 acres not receiving topsoil. The Division has agreed to allow Energy <br />Fuels to seed directly into refuse cap material on these 17.1 acres. Two growing seasons <br />after seeding the Division will assess the vegetation establishment to determine if Energy <br />Fuels needs to import topsoil. Energy Fuels has a commitment in the permit to import <br />topsoil if determined [o be necessary. <br />No seeding, mulching or soil stabilizing measures took place in the fall of 1994. Chiselling <br />on the contour was conducted in February 1995 to help repair and slow the formation of <br />rills and gullies on the slope. <br />The recommended seeding windows in the Trinidad area are October 1-November 15, and <br />March 15-April 30. The Raton Creek Permit commits to seeding during these <br />recommended seeding times, permit page 519. <br />The Trinidad area experienced a dry winter. Site conditions at the Raton Creek Mine were <br />dry up until my May 9. 1995 inspection. In a telephone conversation with Mr. Al Weaver <br />on May 12, 1995 (notes recorded but not written on phone log form) I reminded AI of the <br />need to seed this spring. He said seeding was planned for May 17-20, 1995. <br />
