Box 500 ) <br />1058 County Road 100 ) <br />Carbondale, CO 81623 ) <br />NOTICE OF VIOLATION M-92-024 <br />AND ORDER TO PAY <br />CIVIL PENALTY <br />T0: Mid-Continent Resources and all other persons engaged in or <br />owning or controlling the following operation: The Mid-Continent <br />Resources Limestone Quarry. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the <br />following findings of fact: <br />1. Mid-Continent Resources, Inc. is permitted to conduct a mining <br />operation under the terms of Permit M-82-121 located in Section 36, <br />Township SN, Range 89W of the 6th P.M. in Garfield County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public <br />Hearing on November 18, 1992 to consider issuance of civil penalties <br />per C.R.S. 34-32-101 ~ secr• against Mid-Continent Resources and <br />Permit No. M-82-121. <br />3. The Division of Minerals and Geology presented evidence at the <br />Formal Public Hearing on November 19, 1992 demonstrating that: <br />a. Mid-Continent has performed corrective actions ordered at a <br />previous formal public hearing held on April 23, 1992 and <br />included in the subsequent Notice of Violation M-92-024. <br />
