OSM is in agreement with the Proposed Decision.
The Colorado Department of Natural Resources, Division of Minerals and
Geology (DMG) conducted the required Phase I Bond Release inspection of the
Marr Mine, 720 Pit, on June 5, 1995. DMG provided notification of the
inspection to OSM's Denver Field Division (DFD) and Albuquerque Field Office
(AF01. OSM did not participate in this inspection, but did participate in the
initial May 12, 1994, Phase I Bond Release inspection of this site (see OSM
5/25/94 Mine-Site Evaluation Inspection Report).
DFD has reviewed the DMG June 5, 1995, Bond Release Coal Inspection Report
and finds that OSM concerns identified on the May 12, 1994, inspection have
been remediated through the appropriate permitting actions and implemented in
the field.
DFD acknowledges that no release of Federal Lands is proposed for the 720 Pit,
therefore, no concurrences are necessary from any Federal Land Management
Agencies. DMG's Proposed Decision, in accordance with Colorado Rule
3.03.1(3)(d), indicates that sufficient bond will remain after the Phase I Release
to complete the approved reclamation plan. DMG proposes to release
