Affiant, being of lawful age and duly sworn, states as
follows:
1. My name is Olive McCollum Goldman. My residence and
domicile is 3661 Ella Lee Lane, Houston, Texas 77027 .
2. I am a trustee of The Eagle River 1978 Trust.
3. I executed and caused to be recorded with the Clerk
and Recorder of Eagle County, Colorado a true affidavit concerning
The Eagle River 1978 Trust, a true copy of which is attached hereto
as Exhibit 1.
9 . At no time prior to March 1, 1979 did any one provide
me with a copy of the notice attached hereto as Exhibit 2.
5. At no time prior to March 1, 1979 did Nottingham Sand
and Gravel Companv or its agents inform me of their application for a
Permit to mine gravel on land next to the Ranch in Eagle County,
Colorado held in trust by The Eagle River 1978 Trust.
