CDOH-APCD Permit 12FR370(F)-2; Southfield Mine, <br />NOV C-91-32, Permit No. 81-014 <br />.~- <br />Dear Mr. Thayer: <br />On December 19, 1991, the Division finished a complete inspection at the <br />Southfield Mine, operated by Energy Fuels Coal Inc. During this inspection <br />I observed that Air Emissions permit 12 FR370C(F)-2 allowed the mine to <br />stockpile 10,000 tons of clean coal. During the inspection the mine had <br />stockpiled in excess of 20,000 tons. Visual dust emissions from the pile were <br />not observed during the inspection which ran from December 17 through December <br />19. <br />The Colorado Surface Coai Mining Reclamation Act statute 34-33-iii(1)(i) <br />requires a coal mine operator to document the steps taken to comply with <br />applicable State and Federal air and water quality laws. The regulations go <br />on to require an operator to conduct his operations in compliance with the <br />applicable State and Federal regulations. As a consequence, we issued Notice <br />of Violation 91-32, and it is enclosed for your review. This violation <br />requires the operator to achieve compliance with their Air Emissions permit by <br />March 31, 1992. This deadline was set at 90 days from issuance, the maximum <br />period granted for violation abatement. <br />The operator intends to revise their permit to increase t <br />stockpile volume. I understand that you have a statutory <br />in which to approve a revised Air Pollution Notice (APN). <br />review of this permit modification be expedited to enable <br />their abatement deadline.
