Box 591 <br />Lamar, Colorado 81052 <br />Re: Valco, Inc.'s, "Lamar West Pit", Prowers County <br />File No. 81-132 <br />Dear Mr. Gregg: <br />Action by the Colorado Mined Land Reclamation Board at their April 24-25, 1985 <br />meeting resulted in a finding that there is reason to believe that a violation <br />to the permit and/or the Mined Land Reclamation Act for the above captioned <br />operation has occurred (34-32-124(1), C.R.S.). <br />This matter will be on the Board agenda as a Formal Public Hearing for <br />consideration of the possible violation, possible cease and desist order on <br />this operation, and possible corrective action(s) for the violation. <br />The hearing is scheduled for May 22-23, 1985 in Room 110 of 1313 Sherman <br />Street, Denver, Colorado beginning at 9:00 a.m. Your matter will be heard as <br />soon after commencement as possible. Please call this office on May 21, 1985 <br />for a more specific day and time. I suggest that you plan to be present or be <br />represented at this hearing. <br />At the hearing, it will be reiterated that you have been in violation of the <br />permit. <br />The provision(s) alledged to have been violated are: <br />1. Exhibit D - Mining Plan <br />"The topsoil will be segregated and preserved for reclamation. <br />Overburden will be used to shape and reslope the banks at 3 to 1 to <br />10 feet below the waterline and 2 to 1 thereafter as required. <br />Excess overburden, if any, will be used to add sinuosity to the <br />shoreline." <br />The facts constituting the alleged violation are: <br />• ~~I ~I~~I~~I~~~~~ ~I~ <br />DEPARTMENT OF NATURAL RESOURCES <br />Davitl H.
